Terms of Service

1. Acceptance of Terms

By accessing or using the IAN platform ("Service") operated by IAN Cloud, Inc. ("IAN," "we," "us"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Description of Service

IAN is an AI-powered DevOps platform that provides infrastructure auditing, cost optimization, security scanning, deployment management, and AI assistant capabilities. The Service includes:

  • Web dashboard at iancloud.ai
  • API access at api.iancloud.ai
  • MCP (Model Context Protocol) server for AI assistant integrations
  • Integration with third-party services (AWS, GitHub, GitLab, Hermes)

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials, including any MCP service tokens you create. You are responsible for all activity that occurs under your account.

4. Your Data

You retain ownership of all data you provide to the Service, including infrastructure configurations, repository data, and organizational information. You grant IAN a limited license to process this data solely to provide the Service.

When you connect cloud accounts (e.g., AWS), you authorize IAN to access your infrastructure data through the permissions you configure. You are responsible for ensuring the access you grant is appropriate for your security requirements.

5. MCP Integrations

When you use IAN through MCP-compatible clients (Claude, Cursor, or other AI assistants):

  • You authorize the client to call IAN tools on your behalf within the scopes you approve
  • You are responsible for the actions taken through MCP tools, including mutating operations (deployments, resource management)
  • You can revoke client authorization at any time through your MCP settings
  • Service tokens you create for programmatic access are your responsibility to secure

6. Acceptable Use

You agree not to:

  • Use the Service to violate any applicable laws or regulations
  • Attempt to gain unauthorized access to other users' data or infrastructure
  • Use MCP service tokens to exceed authorized scopes or capabilities
  • Reverse-engineer, decompile, or attempt to extract source code from the Service
  • Use the Service to conduct attacks against third-party infrastructure
  • Share or distribute MCP service tokens publicly

7. Service Levels

We strive to maintain high availability but do not guarantee uninterrupted service. The Service is provided "as is" and "as available." We will make reasonable efforts to notify you of planned maintenance.

8. Pricing and Payment

Paid plans are billed according to the pricing published at iancloud.ai/pricing. We may change pricing with 30 days' notice. You may cancel your subscription at any time, effective at the end of the current billing period.

9. Limitation of Liability

To the maximum extent permitted by law, IAN shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or infrastructure downtime resulting from:

  • Actions taken by the Service on your infrastructure (including through MCP tool invocations)
  • Recommendations made by AI-powered features
  • Service interruptions or data loss

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold IAN harmless from claims arising from your use of the Service, your violation of these terms, or your violation of any third party's rights.

11. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease. We will delete your data within 30 days of termination unless legally required to retain it.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
